1. Acceptance of Terms

By creating an account, uploading photos, or otherwise using Canopy Check (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. What the Service Is — and Isn't

Canopy Check provides a preliminary visual screening of trees based on photographs you submit. It is a lead-generation and triage tool intended to help you decide whether to request an on-site visit from a certified arborist.

The Service is not a professional arborist assessment. Screening results cannot confirm whether a tree is safe or unsafe and are not a substitute for an in-person evaluation by a qualified, certified arborist. You should not rely on the Service to make decisions about tree removal, pruning, or any matter affecting personal safety or property. If you have urgent safety concerns, contact a certified arborist or emergency services directly.

3. Account Registration

To view results you must create an account. You agree to provide accurate information (including your full name, phone number, and email address) and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

4. Photos You Upload

You retain ownership of the photos you upload. By uploading, you grant us a limited, non-exclusive license to store, process, display, and share those photos with our affiliated tree-service partners and certified arborists for the purpose of providing the Service and following up with you. You represent that you have the right to upload each photo and that doing so does not violate anyone else's rights.

5. Lead Generation and Contact

When you complete a screening, your contact information and screening details may be shared with our partnered tree-service company so an arborist can follow up with you about your trees. By using the Service you consent to being contacted by phone or email for this purpose.

6. Acceptable Use

You agree not to: (a) upload content you do not have the right to share; (b) upload images depicting people in a way that violates their privacy; (c) attempt to reverse-engineer, scrape, or disrupt the Service; or (d) use the Service for any unlawful purpose.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SCREENING OUTPUT IS PRELIMINARY AND MAY BE INCOMPLETE OR INCORRECT.

8. Limitation of Liability

To the maximum extent permitted by law, Canopy Check and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, property damage, or personal injury arising from your use of — or inability to use — the Service, including any reliance you place on screening results.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
